This Content Policy explains what you may and may not publish through Gusto QR. It sits alongside the Terms of Use and the Privacy Policy, and is incorporated into the Terms of Use by reference.
This Content Policy is the “Content Policy” referred to in Section 3.3 of the Terms of Use, and together with Section 3.3 it forms the Acceptable Use Policy. It applies to everything you publish through Gusto QR — menu items and descriptions, categories, prices, images, business details, QR codes and any address a QR code sends people to.
Where this policy and the Terms of Use overlap, the Terms of Use govern. Capitalised terms not defined here have the meaning given in the Terms of Use.
Gusto QR is a technology provider. You — the business operating the account — are the publisher of your menu and the party responsible for it. We host and display what you enter; we do not author it, select it, verify it, or adopt it as our own.
You are responsible for all User Content published from your account, including content added by staff members you invite to your team. Publishing a menu makes it publicly reachable on the internet at its own address, and search engines may index it.
You must have the right to publish everything you upload, and what you publish must be accurate for the business it represents. Section 4 of the Terms of Use sets out your obligation to indemnify us in respect of your User Content.
You may not use Gusto QR to publish, link to, or distribute:
For images you upload, you must own them or hold a licence permitting commercial use. Photographs taken from another restaurant’s website, from a delivery platform, or from a search engine are not licensed for your use.
Stock images inserted through the built-in stock photo search remain subject to the licence of the provider they came from. Gusto QR passes those images through; it does not grant you rights beyond that provider’s licence.
Images produced with the AI image tools are generated on your instruction. You are responsible for the prompt you give and for the result you choose to publish, including whether it plausibly represents the dish you are selling. Do not use the tools to reproduce a third party’s photograph, logo or protected character.
Prices, currency, and any dietary or allergen information you enter are shown directly to your guests and are your representations to them, not ours. Keep them current.
Allergen declarations in particular carry legal weight in many jurisdictions, and a guest may rely on them when deciding what to order. Do not mark an item as free from an allergen unless that is true of how it is actually prepared in your kitchen, including shared equipment and cross-contact. If you cannot state this reliably, leave the field empty rather than guessing.
Gusto QR performs no check on any of this. We do not inspect kitchens, verify recipes, confirm supplier declarations, or validate that a price or allergen field matches reality. The information a guest sees is yours, presented on your behalf, and the responsibility for its accuracy and for any consequence of it being wrong rests with you. Nothing in the product should be treated as a substitute for the food-safety, labelling and consumer-information duties that apply to your business where you operate.
You may list alcohol, tobacco and other age-restricted items where your licence permits you to sell them. You remain responsible for verifying age at the point of service; a digital menu performs no such check.
Do not use a menu to advertise items you are not licensed to sell, or to make medical, therapeutic or health claims about food or drink.
A QR code you generate must lead to your own menu or to an address you control and that a guest would reasonably expect. Where a menu is configured to redirect elsewhere, the destination is subject to this policy exactly as the menu itself would be.
Do not point a code at content unrelated to your business, at an affiliate or ad landing page presented as a menu, or at anything designed to mislead the person who scanned it. Do not print codes generated here on materials for a business that is not yours.
If you believe content published through Gusto QR infringes your rights or breaches this policy, contact us with the address of the menu, a description of the problem, and enough detail for us to identify the material. Copyright complaints are handled under Section 9 (Copyright Policy) of the Terms of Use.
We do not pre-screen, approve or monitor User Content, and we are under no obligation to do so. Menus go live without review. Where we become aware of content that breaches this policy we may, as set out in Section 3.4 of the Terms of Use, remove or modify it, unpublish a menu, or suspend or terminate an account.
Serious cases — content that is unlawful, that endangers guests, or that repeats after notice — may be actioned without prior warning. We may tell you what was removed and why; nothing in this policy obliges us to give notice before or after acting.
We may update this policy as the product and its obligations change. The revision date above shows when it last changed, and continued use after a change means you accept the updated policy.
